  • Sellers are responsible for any copyright claims against their Content.
  • Sellers maintain ownership of their original Content.

4.2. Buyer Rights and Responsibilities:

  • Buyers must comply with the license terms specified by Sellers.
  • Licenses are non-transferable unless explicitly stated.
  • Buyers cannot resell or redistribute purchased Content without proper authorization.
  • Buyers must respect copyright and intellectual property rights.

5. Platform Rules

5.1. Prohibited Content:

  • Copyrighted material without proper authorization.
  • Offensive, illegal, or harmful content.
  • Malware or harmful code.
  • Content that violates third-party rights.

5.2. Prohibited Activities:

  • Harassment or abuse of other users.
  • Manipulation of ratings or reviews.
  • Creation of multiple accounts for deceptive purposes.
  • Interference with Platform operations.

6. Payments and Fees

6.1. Transaction Terms:

  • All payments are processed in USD.
  • Platform fees will be clearly disclosed.
  • Sellers receive payment after any applicable holding period.
  • Refunds are subject to our Refund Policy.

6.2. Platform Commission:

  • Platform retains a commission (10%) on each sale made by Free "Core" Tier Users on marketplace.
  • Commission rates are subject to change with notice.
  • Sellers are responsible for applicable taxes.

7. Intellectual Property

7.1. Platform IP: All Platform branding, design, and features are proprietary. Users may not copy or reproduce Platform elements without permission.

7.2. User Content: Users retain rights to their original Content and grant Platform a limited license to display and promote Content. Platform may remove Content that violates these Terms.

7.3. Promotional Rights: By uploading Content to the Platform, Sellers/Producers/Artists grant BrowseBeats the non-exclusive right to create and share promotional materials (including but not limited to promo videos, social media posts, and website features) using their Content for marketing and promotional purposes. Sellers retain full ownership and copyright of their original music and Content. Sellers may opt out of promotional activities at any time by emailing [email protected] with the subject line "Opt Out - Promotional Rights."

8. Dispute Resolution

8.1. User Disputes:

  • Users agree to attempt good-faith resolution.
  • Platform may mediate but is not obligated to.
  • Platform decisions regarding disputes are final.

8.2. Copyright Claims:

We follow DMCA procedures for copyright claims. Users must provide required documentation for claims. False claims may result in account termination.

9. Limitation of Liability

The Platform provides Services "as is" without warranty. We are not liable for user disputes, Content quality, lost profits, or data.

10. Termination

  • Users may delete their account at any time.

11. Changes to Terms
